Legal Provisions and Terms of Submission
By submitting artwork to the "Adoption Art Contest" ("Contest"), each entrant ("Entrant") agrees to and acknowledges the following terms and conditions:
Originality: All submissions must be original creations of the entrant. Do not use copyrighted images or elements that you do not have permission to use. Entrants represent and warrant that they are the sole creator and owner of all submitted artwork ("Submitted Work") and that the Submitted Work does not infringe upon the intellectual property rights or any other rights of any third party. Upon submission, the Entrant irrevocably grants to Iowans for Adoption a perpetual, royalty-free, worldwide, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, display, perform, adapt, modify, publish, and create derivative works from the Submitted Work in any media now known or hereafter developed, for any purpose related to Iowans for Adoption's mission, including but not limited to, marketing, promotion, fundraising, and the sale of merchandise (such as t-shirts, mugs, bags, newsletters, etc.).
Designs should be family-friendly and appropriate for all ages.
The Entrant understands and agrees that, beyond the recognition and potential use on merchandise/content as described in this Contest, no further monetary compensation, royalties, or payment of any kind will be provided for the Submitted Work or the rights granted herein.
Iowans for Adoption reserves the sole and absolute right to select, or not select, any Submitted Work for use on its merchandise, in social media, on our website, or for any other purpose. Iowans for Adoption is under no obligation to use any Submitted Work, even if it is deemed a winning entry. Iowans for Adoption may modify the Submitted Work as it deems necessary for its intended use, including but not limited to changes in color, size, text additions, or placement.
The Entrant represents and warrants that they have the full power and authority to enter into this agreement and grant the rights herein, and that the Submitted Work is free and clear of any liens, claims, or encumbrances.
The Entrant agrees to indemnify and hold harmless Iowans for Adoption, its officers, directors, employees, volunteers, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from any breach of the Entrant's representations or warranties, or from any claim that the Submitted Work infringes upon the intellectual property or other rights of any third party.
By entering, Entrants grant Iowans for Adoption the right to use their name or pseudonym, or alias and any message the entrant wants to convey about the art (without compensation).
This Contest and these terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws principles.
